After the marriage, the immigrant may then take the steps of seeking lawful permanent residence.

If you wish to take this step with your non-citizen fiancé, you must be a valid citizen of the United States yourself. Both parties must be legally clear to marry, which means neither of you can currently be married to someone else at the time you apply for the visa. Additionally, you are not eligible for this type of visa if you and your fiancé plan to marry outside of the United States.
